Inshore Bite Tournament

Participation Agreement, Assumption of Risk, Liability Waiver, and Release

Version: 0 (final) Status: FINAL v0. Approved by Will McLean (counsel and Tournament Director) on October 5, 2026. In force on the date it is published and shown on the Register accept screen. Applies to: Halloween Slam Open 2026 and any later Inshore Bite tournament I enter through the app.

This agreement is between me (“Participant”) and MCLEAN GAS COMPANY LLC, together with Will McLean and their owners, officers, employees, contractors, sponsors, and affiliates (together, “Released Parties”). Inshore Bite is the name of the app. It is not a filed fictitious name.

By tapping Accept, creating an account, or registering for a tournament, I agree to this document. My electronic acceptance is my signature.

1. What I am doing

I am entering a voluntary recreational fishing tournament. I may fish from a boat, kayak, paddle craft, shore, pier, bridge, or wade. I decide when, where, and how I fish. Inshore Bite provides an app, scoring, and (if offered) a prize. It does not supervise my trip, my boat, or the water.

2. Eligibility

I am at least 18 years old and legally able to enter. If I am under 18, a parent or legal guardian accepts this agreement for me and I may not enter until they do. I will follow Florida law and FWC rules, including licenses, size and bag limits, and closed seasons. Breaking those rules can get me disqualified.

3. Assumption of risk

I know inshore fishing and boating are dangerous. Risks include, without limitation: drowning; weather, lightning, wind, and sea state; tides and currents; collisions; propeller and equipment injury; slips and falls; hooks, gaffs, and knives; marine life; other boats and other people; heat, cold, and exhaustion; and travel to and from the water. I understand Inshore Bite does not control the water, the weather, or other anglers. I freely assume all of these risks, known and unknown, even if they arise from the ordinary negligence of the Released Parties, to the fullest extent Florida law allows.

4. Release of liability

To the fullest extent Florida law allows, I release, waive, and forever discharge the Released Parties from any and all claims, damages, losses, and expenses (including attorneys’ fees) arising out of or related to my participation, my travel, my catch, my photos, my use of the app, or any prize, including claims based on ordinary negligence.

This release does not apply to claims that Florida law says cannot be waived, including (if applicable) gross negligence, willful misconduct, or intentional harm by a Released Party. I understand that and still choose to enter.

5. Indemnity

I will defend and indemnify the Released Parties against claims brought by anyone else because of my acts or omissions, my guests, my boat, my gear, or my entries, including reasonable attorneys’ fees.

6. Official rules and prize

Tournament rules, scoring, species, dates, entry limits, and prizes are in the official rules in the app (a separate document). I have read them or I will read them before I fish. I understand I may win nothing. Any prize (including the Halloween Slam “$1,000 in gear”) is awarded only as the official rules say. If I am a potential winner I will complete any extra forms they ask for (tax, shipping, identity, prize acknowledgment) before I receive anything. Failure to do so can forfeit the prize.

7. Photos, name, and likeness

I grant Inshore Bite a non-exclusive right to use my name, hometown, photos, catch photos, and tournament results for the event and for promoting Inshore Bite, in any media, without extra payment. I can ask them to take down a specific photo; they will try, but they do not have to pull printed or already-distributed material.

8. Medical

I am healthy enough to fish. If I get hurt, I authorize reasonable emergency care and I am responsible for the cost. I will not hold the Released Parties responsible for the quality of that care.

9. Insurance

I am responsible for my own health, boat, and liability insurance. Nothing in this agreement is insurance.

10. Electronic acceptance

I agree that tapping Accept, checking a box, or otherwise accepting in the app is a valid electronic signature under the Florida Uniform Electronic Transaction Act and the federal E-SIGN Act. Inshore Bite may store my user id, the document version, the time, and my device or IP as proof.

11. Other terms

Florida law governs, without regard to conflict-of-law rules. I will bring any claim only in state or federal court in Pinellas County, Florida. If a court strikes one part of this agreement, the rest still stands. This is the whole agreement on liability for my participation. It can only be changed in a new version that I accept in the app.

I HAVE READ THIS AGREEMENT. I UNDERSTAND I AM GIVING UP THE RIGHT TO SUE THE RELEASED PARTIES FOR ORDINARY NEGLIGENCE, TO THE EXTENT FLORIDA LAW ALLOWS. I AM ACCEPTING IT FREELY.

Checkbox copy (app): I am 18 or older. I have read the Participation Agreement and Official Rules, I assume the risks of fishing this tournament, and I release Inshore Bite and Will McLean from liability to the extent Florida law allows.

Store on accept: waiver_version, rules_version, accepted_at (ET), user_id. Do not let Register complete without this.
